Singer suing coffee titans for poor record sales

Carly Simon is suing Starbucks after blaming their record label Hear Music for the poor sales of her 2008 album This Kind Of Love.

Simon claims that the company didn’t do enough to promote her album -which she had intended to be her last – which is why it only shifted 124,000 copies.

Simon’s attorney’s filed a lawsuit on Friday claiming that the album wasn’t available in a "substantial number" of Starbucks stores when it first came out and that it was later slashed in price.

"By doing so, Starbucks stigmatized Ms. Simon’s album as an album that could not be sold at full price," they claimed.

Yesterday, Starbucks issued a statement claiming they had met all their contractual obligations.

"Unfortunately, sales continued to lag as the title received tepid response from music consumers," they said. "Other retailers faced the same fate with this CD."
